Secretary of state may designate private entities to provide commercial look-up services and collect authorized fees, with web portal development fees retained by the private entity for state web portal development rather than credited to transportation administration collection fund.

Private entities must be selected through competitive bidding unless department affirmatively finds another method serves public interest, with findings reported to relevant state departments and legislative appropriations subcommittees at least 90 days before work commences.

Driver education providers and limo carriers must subscribe to commercial look-up service, maintain current copies of driving records for public review, and include notice in contracts that instructor driving records are available for public review.

Violations subject to fines up to $500 for each failure to provide required information by driver education providers, limo carriers, and limousine drivers.
