MI HB5200

Amends MCL 333.2455 of the Public Health Code to authorize local health departments and the state department to issue orders requiring property owners to correct pest infestations at the owner's expense.

Expands the grounds for health department orders to include infestations alongside existing violations, nuisances, unsanitary conditions, and causes of illness.

Defines "infestation" as a sustained population of one or more pest species in numbers or quantities large enough to be harmful, threatening, or obnoxious, and defines "pest" as any plant or animal detrimental to humans or human concerns.

Allows health departments to remove infestations and seek warrants if property owners do not comply with orders, with owners liable for all incurred expenses; unpaid expenses may be assessed against the property as taxes.

Makes occupants or persons who caused or permitted the infestation liable to the property owner for amounts paid or assessed, recoverable through civil action.

Takes effect only upon enactment of House Bill 5199 and House Bill 5201 from the 97th Legislature.
