HB 5357 Summary

• Amends the Michigan Insurance Code (1956 PA 218) to restrict insurance coverage for physical therapy services unless provided by a licensed physical therapist or assistant under supervision and pursuant to a referral from a licensed health care professional (parts 166, 170, 175, or 180 of the Public Health Code).

• Exempts insurers from reimbursement requirements for optometry, chiropractic, and physical therapy services unless those services were within the scope of practice as defined on specific dates (May 20, 1992 for optometry; January 1, 2009 for chiropractic; and with referral requirement for physical therapy).

• Applies restrictions to both personal protection insurance (section 3107b) and disability insurance policies offered under prudent purchaser agreements (sections 3405, 3475, and 3631).

• Requires insurers offering restrictive prudent purchaser policies to also offer alternative policies without exclusive provider requirements or financial incentives favoring network providers.

• Takes effect only if House Bill 5356 is enacted into law (tie-bar provision).
