HB 5460 Summary

• Requires the Michigan Department of Transportation to secure pavement warranties for full replacement or appropriate repair on state trunk line highway projects exceeding $1,000,000 and undertaken after the effective date, where practicable.

• Extends the same pavement warranty requirement to county road commissions and cities/villages for their respective projects exceeding $1,000,000 in cost, subject to federal highway administration and department approval.

• Mandates annual public reporting by the department, county road commissions, and municipalities listing all warranties secured, whether any were redeemed, and projects over $1,000,000 where warranties were not obtained, including project type, cost, and expected lifespan.

• Requires county road commissions and municipalities to submit proposed warranty programs to the department for approval by February 1, 2016, with implementation required within one year of approval.

• Takes effect only upon ratification of House Joint Resolution UU by Michigan voters as a constitutional amendment.
