Establishes specific disqualifying offenses including: relevant crimes under federal law, felonies involving violence/force/cruelty/sexual conduct/abuse/neglect/firearms occurring within 15 years, other felonies within 10 years, and various misdemeanors within 3-10 years depending on offense type.

Permits conditional employment pending criminal history results if applicant signs statement attesting to clean record, facility conducts public records search showing no disqualifications, applicant resided in state for 12 months, and applicant provides fingerprints within 10 business days.

Requires applicant consent for criminal history checks; prohibits facilities from charging prospective employees for background check costs; establishes fingerprint database to provide automatic notification of subsequent arrests matching individuals previously screened.

Clarifies that "home health agency" means entities as defined in section 20173a of the public health code, and removes prior definition specifying Medicare certification requirement.
