HB 5681 Summary

• Amends the General Law Village Act (1895 PA 3, MCL 67.1) to add village council authority to regulate or prohibit public nudity within village boundaries.

• Defines "public nudity" as knowingly or intentionally displaying genitals, anus, or female breasts with less than fully opaque coverage in a public place, or for payment or promise of payment.

• Explicitly excludes breastfeeding and expression of breast milk from the definition of public nudity, regardless of whether the nipple or areola is visible.

• Excludes material defined under 1984 PA 343 (MCL 752.362) and sexually explicit visual material defined under 1978 PA 33 (MCL 722.673) from the public nudity definition.

• Effective only if House Bills 5678, 5679, and 5680 are also enacted into law (tie-bar provision).
