Construction contracts with public agencies must contain bid specifications that comply with new requirements and designate persons representing the contractor and agency for submitting and receiving progress payment requests.

Progress payments must be made within 30 days after an architect or engineer certifies work is in place, or 15 days after the public agency receives funding from federal or state sources, whichever is later.

Bid specifications must be written by an architect, engineer, designer, or draftsman who is not an employee or representative of any material manufacturer involved in the project.

Bid specifications must include performance standards for materials, or if impractical, list at least 3 examples of acceptable materials from different manufacturers and state that equivalent materials are acceptable.

Bid specifications cannot designate preferred manufacturers unless they identify the performance standards supporting that preference, and materials meeting those standards are considered equivalent to the preferred manufacturer's product.
