Amends Section 5 of the Motor Carrier Safety Act of 1963 to replace references to the "motor bus" transportation act with the "commercial passenger transportation act" of 1982.

Exempts from the Motor Carrier Safety Act various vehicle categories including farm vehicles, self-propelled farm implements, school buses, and commercial buses operating under the commercial passenger transportation act.

Exempts government-owned commercial motor vehicles from most safety requirements, except for specific federal regulations including medical certification (49 CFR 383.71(h)) and parts 382, 391, 392, and 393.

Allows combination vehicles under 26,000 pounds (with trailers under 15,000 pounds) to use surge brakes for intrastate operation, but prohibits surge brakes on hazardous material vehicles and vehicles designed for more than 8 passengers.

Restricts intrastate motor carriers from requiring construction-related vehicle operators to exceed 70 hours on duty per 7 days or 80 hours per 8 days, and limits daily operation to 12 hours or 16 hours on duty.

Bill takes effect only if Senate Bill No. ____ or House Bill No. 5908 is enacted into law.
