HB 6003 Summary

• Amends the Revised Judicature Act of 1961 to modify notice requirements for property seizure and civil forfeiture proceedings under sections 4704 and 4706a.

• Requires seizing agencies or prosecutors to notify within 7 days the person charged with a crime, property owners, lienholders, mortgagees, security interest holders, and crime victims when personal property is seized or a lien is filed against real property.

• Changes publication method for notice when recipient names and addresses cannot be determined: before January 1, 2015, notices must be published in a newspaper of general circulation for 10 successive days; after December 31, 2014, notices must follow Michigan court rules for publication as ordered by a court.

• Requires seizing agencies or prosecutors to give notice within 7 days to all previously notified persons when seized property is returned to the owner or when a lien on real property or motor vehicle is discharged.

• Gives attorneys 60 days from notice to examine seized money before it is deposited with a financial institution.
