Senate Bill 94 Summary

• Prohibits state agencies, political subdivisions, state/local employees, and Michigan National Guard members from assisting federal armed forces in investigating, prosecuting, or detaining persons under Section 1021 of the National Defense Authorization Act for Fiscal Year 2012 if such assistance would violate the U.S. Constitution, Michigan Constitution, or state law.

• Exempts joint task forces, partnerships, and cooperative agreements between state/local law enforcement and federal law enforcement from the restriction, provided they are not specifically for purposes of investigating, prosecuting, or detaining persons under Section 1021 of the NDAA.

• Effective date: March 27, 2014 (90 days after enactment on December 26, 2013).
