Pharmacy benefit managers must maintain a contracted pharmacy network sufficient to ensure access to covered individuals.

PBMs are prohibited from mandating that covered individuals use a specific pharmacy if the PBM has an ownership interest in that pharmacy or the pharmacy has ownership interest in the PBM.

PBMs cannot provide incentives to encourage use of a specific pharmacy if that incentive only applies to a PBM-owned pharmacy.

PBMs cannot require retail pharmacy participation in one network as a condition for participating in another network managed by the same PBM, and cannot exclude qualified pharmacies that accept PBM terms, meet licensure requirements, and have not been excluded from federal or state programs.

Benefit plans contracting with PBMs must permit covered individuals to receive prescription drug benefits including 90-day supplies at any network retail pharmacy without imposing different copayments, deductibles, or conditions than those imposed for mail-order pharmacy use.
