Bill
AI Summary
Senate Bill 1063 Summary
-
Authorizes local units of government (counties with population over 100,000 and municipalities within those counties) to operate automated traffic enforcement safety devices to detect and enforce speed violations near schools and institutions of higher education.
-
Requires devices to be placed only within 2,500 feet of school or higher education institution perimeters, operate only between 6 a.m. and 8 p.m., undergo annual calibration checks, and include a 30-day warning-only period after initial deployment.
-
Establishes citation procedures requiring police officer review and approval of recorded images before notices are mailed to vehicle owners, with fines distributed as follows: costs of program operation, then 70% to local government general fund (with 20% going to school safety programs) and 30% to library purposes.
-
Creates affidavit-based system allowing vehicle owners to transfer responsibility to actual drivers by providing sworn statements with names and addresses; limits owners to one such transfer per citation and prohibits arrest or imprisonment for non-payment.
-
Specifies that violations detected by automated devices do not result in driver's license points and includes sunset clause repealing the automated enforcement sections 7 years after enactment; ties bill's effectiveness to passage of related legislation.
