House Bill 4343 Summary

• A registered motor vehicle repair facility loses its registration status if more than 30 days pass after expiration without a renewal application being received by the administrator.

• The administrator may issue verbal or written warnings, cease and desist orders, or assess administrative fines up to $5,000 for first violations and $7,500 for subsequent violations within 7 years for operating without required registration.

• Violators must pay assessed fines within 20 days and submit a registration application if not already registered; fines not paid within 60 days can be referred to the Department of Treasury for collection through tax refund offsets and wage garnishment.

• If a facility registers within 20 days of a fine assessment and receives approval within 45 days, the administrator shall reduce the fine by 50%.

• The act takes effect 90 days after enactment.
