State construction projects exceeding $100,000 for highways, streets, roads, and bridges must be awarded by competitive bidding unless the department finds another method serves the public interest.

Department director must report findings to the state transportation commission 90 days before work commences, and promptly to appropriations committees of both legislative chambers.

Emergency action projects may proceed without prior reports, but findings must be filed promptly afterward.

Local road agencies (county commissions, cities, villages) must use competitive bidding for projects exceeding $100,000, excluding maintenance, unless they find another method in the public interest.

Advanced traffic management system and signal installation or upgrading are exempt from local road agency bidding requirements; local agencies must report findings to their respective governing bodies before work begins.
