HB 4863 Summary

• Amends the Michigan Zoning Enabling Act to make zoning ordinances subject to the Textile Recycling Bin Act in addition to existing requirements.

• Prohibits counties and townships from regulating or controlling oil and gas well drilling, completion, or operation, and removes local jurisdiction over permits for these activities.

• Restricts local zoning ordinances from preventing extraction of valuable natural resources by mining unless very serious consequences would result from extraction.

• Defines valuable natural resources as those from which a person can receive revenue and reasonably expect to operate at a profit.

• Allows local governments to reasonably regulate hours of operation, blasting, noise, dust control, and traffic related to mining, provided such regulations accommodate customary mining operations.

• Takes effect 90 days after enactment, contingent on passage of HB 4862.
