HB 5130 Summary

• Adds definition of "hoop house" as a temporary structure with noncombustible arches covered in translucent plastic, no permanent foundation or impermeable floor, built according to manufacturer specifications.

• Exempts hoop houses from building permit and code requirements if they do not store hazardous chemicals, do not redirect drainage, and if used for retail sales, are limited to 400 square feet with at least 50% of products produced on the owner's farm.

• Changes language regarding agricultural buildings from "incidental to" to "associated with" agricultural purposes to clarify that buildings used for agricultural operations without retail sales are exempt from permitting requirements.

• Revises building permit application requirements and procedures, including clearer formatting of required information submissions for architects, engineers, and contractors.

• Effective 90 days after enactment into law.
