HB 5319 Summary

• Amends the Michigan Code of Criminal Procedure to allow prosecuting attorneys to file complaints against juveniles ages 14-17 for specified serious violations (murder, assault, armed robbery, drug trafficking, escape from secure facilities, etc.)

• Establishes "specified juvenile violations" including violations of Michigan Penal Code sections 72, 83, 84, 86, 89, 91, 110a(2), 186a, 316, 317, 349, 520b, 529, 529a, and 531, plus Public Health Code drug violations, and related attempts, conspiracies, and solicitations

• Allows magistrates to find probable cause for specified juvenile violations and transfer cases involving juveniles to family division circuit court, where courts may waive jurisdiction to try juveniles as adults under existing law

• Creates "dangerous weapon" definition including loaded or unloaded firearms, knives, brass knuckles, blackjacks, clubs, and objects designed or carried for use as weapons

• Takes effect 90 days after enactment and is contingent on passage of House Bill 5317
