HB 5323 Summary

• Amends the Social Welfare Act to require facility staff to immediately notify local police, county sheriff, or state police when a juvenile escapes from a state-funded or authorized facility or residence (other than their own home or parent/guardian's home).

• Requires law enforcement agencies receiving escape notifications to enter the information into the law enforcement information network without undue delay.

• Defines "escape" as leaving without lawful authority or failing to return to custody when required, and clarifies that "juvenile" includes individuals under juvenile court jurisdiction under the Probate Code and circuit court jurisdiction under MCL 600.606 (until its repeal).

• Modifies definitions in Section 117a related to county juvenile agency services, county juvenile agency services, and juvenile justice services with clarifying language regarding MCL citations and references to the Probate Code.

• Takes effect 90 days after enactment, contingent upon passage of HB 5317 or the corresponding Senate Bill.
