HB 5371 Summary

• Adds a new requirement for the Department of Environmental Quality to hold a public hearing before issuing a permit for hydraulic fracturing operations if requested by the affected city, village, township, or any person who may be adversely impacted by the operation.

• Defines "hydraulic fracturing" as injecting foam or fluid into a well under pressure to create fractures in a formation to enhance hydrocarbon production.

• Requires the supervisor of wells to provide information about oil and gas well permit applications (including whether hydraulic fracturing will be used) to counties and the city, village, or township where the well is proposed to be located.

• Allows local governments and affected persons to submit written comments and recommendations regarding hydraulic fracturing permit applications, which the supervisor must consider during review.

• Takes effect 90 days after enactment into law.
