HB 5379 Summary

• Amends the Revised School Code to add definitions for "opioid antagonist" (naloxone or FDA-approved equivalent) and "opioid-related overdose" to Section 5.

• Expands liability protections in Section 1178 to include school employees who in good faith administer opioid antagonists consistent with school policies, shielding them from civil and criminal liability except for gross negligence or willful misconduct.

• Requires school boards beginning in the 2016-2017 school year to ensure at least one trained employee per school can administer opioid antagonists, with training conducted under supervision of a licensed registered professional nurse.

• Mandates school boards develop and implement policies for possession and administration of opioid antagonists, including maintaining at least one package per school and requiring parent/guardian notification when administered to pupils.

• Requires school districts to annually report all instances of opioid antagonist administration to pupils to the Department of Education, and directs the department to develop medication administration guidelines in consultation with health and education organizations.
