HB 5469 Summary

• Establishes the Legislative Open Records Act (LORA) as Part 2 of the Freedom of Information Act, creating a public records access framework for Michigan's legislative branch.

• Grants all persons (except incarcerated individuals) the right to inspect, copy, or receive copies of legislative public records upon written request to a LORA coordinator, with records defined as writings possessed by a legislative body for 15 days or more.

• Requires LORA coordinators to maintain copies of all written record requests for at least 1 year and employees to forward requests within 3 business days; allows persons to subscribe to regularly issued public records for up to 6-month renewable periods.

• Prohibits public bodies from destroying or altering records within 15 days of possession if they would become public records, and requires protection of records from loss, unauthorized alteration, mutilation, or destruction.

• Takes effect January 1, 2017, contingent upon enactment of companion bills HB 5470-5478.
