HB5477 Summary

• Amends Section 13 of the Freedom of Information Act to modify exemptions from public disclosure of records by public bodies.

• Changes the department responsible for archaeological site location disclosure from "Department of History, Arts, and Libraries" to "Department of Natural Resources."

• Adds new exemption (z) for records in the executive office of the governor or lieutenant governor relating to appointments, removals, reprieves/pardons, budget recommendations, expenditure reductions, and legislative messages.

• Removes previous subsection (4) that prohibited withholding public records transferred to the governor's office after a FOIA request was received by another state agency.

• Takes effect January 1, 2017, contingent on enactment of HB5469.
