Amends the Local Financial Stability and Choice Act to add a new subsection (5) limiting the emergency manager's authority over fire safety operations, providing that the emergency manager's powers do not supersede those of the state fire marshal, fire department commanding officers, or firefighters acting under orders in situations involving dangerous conditions.

Adds clarifying language to subsection (1)(ee) specifying that the emergency manager's general authority to exercise powers of local government officers and entities is "except as otherwise provided in subsection (5)," creating a carve-out for fire safety matters.

Changes reference in subsection (1)(m)(ii) from MCL 38.1140m to MCL 38.1141 regarding compliance with the Public Employee Retirement System Investment Act when the emergency manager serves as sole trustee of a local pension board.

Takes effect 90 days after enactment and is contingent on the enactment of either Senate Bill No. ____ or House Bill No. 5609.
