Only persons specified in sections 23a(1), 23b(1), and 23c may place a child for adoption, with prospective adoptive parents permitted to advertise for or recruit biological parents or guardians.

Biological parents, guardians, courts, departments, or child placing agencies with authority may advertise for or recruit prospective adoptive parents only for court-supervised adoptions of specific children.

No other person or entity may advertise for, solicit, or recruit prospective parents to facilitate child transfer, adoption, or permanent placement.

First violation is a misdemeanor punishable by up to 90 days imprisonment or $100 fine; subsequent violations are felonies punishable by up to 4 years imprisonment or $2,000 fine, with courts authorized to enjoin further violations.

"Advertise for, solicit, or recruit" defined as communicating in person, in writing, or via any public or private medium to locate previously unknown persons for temporary or permanent child placement.
