HB 5633 Summary

• Creates new civil infraction option for first-time violations of operating with a suspended license under section 321a suspension, with maximum $150 fine instead of criminal misdemeanor charges; applies only once per lifetime.

• Eliminates driver responsibility fees for individuals whose license was suspended solely for failure to answer a citation or comply with court orders under section 321a, if it is their first violation.

• Establishes that violations of section 904(1) due to section 321a suspensions are civil infractions (not prior convictions for enhanced sentencing purposes) and modifies penalties for certain unlicensed driving offenses.

• Reduces driver responsibility fees assessed under section 732a on staggered schedule: 75% effective October 1, 2015; 50% effective October 1, 2016; 25% effective October 1, 2018; eliminated entirely October 1, 2019.

• Takes effect 90 days after enactment and is contingent on passage of HB 5634.
