Removes the exception for cigarette vending machines in certain establishments (bars with Class C liquor licenses and private membership areas) and bans all tobacco product vending machines in places of public accommodation where minors have access.

Expands the definition of "tobacco product" in the penal code to include electronic smoking devices approved by the FDA as tobacco cessation products, in addition to traditional tobacco products.

Updates the definition of "place of public accommodation" to reference the Persons with Disabilities Civil Rights Act (1976 PA 220, MCL 37.1301) rather than repeating the definition in statute.

Modifies Section 473 to update the definition of "tobacco product" to align with the Tobacco Products Tax Act (1993 PA 327, MCL 205.422) and include FDA-approved electronic smoking devices, and clarifies that tobacco use restrictions apply to school property except outdoor areas after 6 p.m. or when school is not in session.

Conditions the bill's effectiveness on the enactment of House Bill No. 5687 or Senate Bill No. ____ of the 98th Legislature.
