Creates a new criminal offense for assaulting or assaulting and battering an individual with a developmental disability if the perpetrator knows of the disability, punishable as a misdemeanor by up to 1 year imprisonment or $1,000 fine, or both.

Elevates the offense to a felony punishable by up to 5 years imprisonment or $5,000 fine, or both, if the offender has one or more prior convictions for the same offense or substantially corresponding local or state ordinances.

Exempts individuals using necessary reasonable physical force in compliance with Michigan school code section 1312 from prosecution under this statute.

Defines "developmental disability" by reference to Michigan Penal Code section 520a(b).

Takes effect 90 days after enactment into law.
