School districts must provide free transportation to resident pupils attending public or nearest state-approved nonpublic schools if the district already provides transportation at that school level.

School districts are not required to transport pupils living within 1-1/2 miles by nearest traveled route to their school.

School districts are not required to transport nonpublic school pupils living less than 1-1/2 miles from a public school where public students are not transported, but must transport those pupils from that public school to their nonpublic school.

School districts transporting resident pupils to public schools outside the district must also transport or pay for transportation of resident pupils attending nonpublic schools at least to the same distance and direction as the public schools.

The act takes effect 90 days after enactment.
