HB 5848 Summary

• Requires auto glass facilities performing installation, repair, or replacement of motor vehicle glass to register with the Secretary of State, with exemptions for single-establishment employees, personal vehicle work, motor vehicle service facilities, and motor vehicle dealers.

• Establishes Secretary of State as administrator to register facilities, maintain a public registry, provide consumer information, and promulgate rules under the Administrative Procedures Act.

• Requires registration applicants to provide facility and owner information, resident agents/officers/directors/partners, 5-year occupational history of major owners and their leadership, facility description, irrevocable appointment of Secretary of State for service of process, and copies of all customer-facing documents (contracts, estimates, invoices, warranties, waivers).

• Authorizes administrator to inspect facilities during business hours, require maintenance of business records for 5 years, issue cease and desist orders, temporarily suspend registrations, and take administrative actions including denial, suspension, revocation, or probation for violations including false statements, unauthorized repairs, blank document signatures, and fraud.

• Establishes criminal penalties of up to 90 days imprisonment or $1,000 fine for first violation and up to 1 year imprisonment or $5,000 fine for subsequent violations; takes effect 90 days after enactment.
