• Expands the prohibition on portable electronic device use while driving to cover any holding or use of the device, replacing the previous text-messaging-specific language.

• Establishes civil infraction penalties of $250 for a first violation and $500 for subsequent violations of the portable electronic device restriction.

• Permits use of portable electronic devices when mounted on windshield, dashboard, or center console with single-swipe activation, when stopped legally off the roadway, or when using voice-operated hands-free operation.

• Allows exceptions for emergency reporting, law enforcement duties, fire department operations, and testing of automated motor vehicles.

• Adds 2 points to a driver's license record for a second violation of the portable electronic device law and 2 points for a third or subsequent violation under MCL 257.602b(1).
