Hospitals must offer patients, legal guardians, or patient advocates the opportunity to designate a lay caregiver before discharge to their residence.

Hospitals must record the designated caregiver's name, relationship to patient, and contact information in the patient's medical record.

Hospitals shall consult with designated caregivers before discharge to prepare them for after-care assistance needs and provide a discharge plan describing those needs.

Hospitals must notify designated caregivers of patient discharge or transfer as soon as practicable upon issuance of discharge order by attending physician.

Act does not create private right of action against hospitals or hold them liable for services caregivers do or do not provide, and does not delay patient discharge or transfer.
