County clerks must distribute written educational materials approved by the state department of health to marriage license applicants regarding prenatal care, sexually transmitted infections, and HIV transmission and prevention, including locations of state-funded HIV testing services.

County clerks cannot issue a marriage license unless the applicant signs and files an application statement with a check-off box confirming receipt of the educational materials and notification of available STI and HIV testing.

If either applicant tests positive for HIV, the testing healthcare provider or local health officer must immediately inform both applicants of the results and counsel them on HIV transmission modes, fetal transmission risk, and protective measures.

Defines "certified nurse midwife," "certified nurse practitioner," "physician," and "physician's assistant" for purposes of administering tests and providing counseling under the section.

Effective date is July 4, 2016, contingent upon enactment of Senate Bills 374, 375, 376, 378, 379, 380, and 381.
