Individuals arrested and charged with prostitution or intravenous drug use offenses must receive information on sexually transmitted infections and HIV, with counseling recommended as voluntary.

Courts must order examination and testing for sexually transmitted infections, hepatitis B and C, and HIV when defendants are bound over to circuit court for specified sexual assault or prostitution-related crimes, with expedited testing within 48 hours available at victim's request.

Upon conviction or juvenile adjudication for sexual assault, prostitution, or intravenous drug use offenses, courts must order mandatory examination and testing for sexually transmitted infections, hepatitis B and C, and HIV, plus mandatory counseling on treatment, transmission, and protective measures.

Test results and medical information are confidential and may only be disclosed to the defendant, local health departments, the state health department, victims, and the Department of Corrections; violation of HIV confidentiality rules is prohibited.

Convicted individuals may be ordered to pay actual and reasonable examination and testing costs within 30 days; failure to pay is a misdemeanor punishable by up to 90 days imprisonment or a $100 fine.
