Senate Bill 450 Summary

• Adds new sections (243f-243j) to the Michigan Penal Code establishing comprehensive regulations for fireworks, including definitions of Class B and Class C fireworks and prohibited items such as blank cartridges, unmanned balloons, firecrackers, skyrockets, and bottle rockets.

• Permits local city, village, or township governments to issue permits for otherwise-prohibited fireworks used for outdoor pest control, agricultural purposes, or public displays by approved organizations after applicants demonstrate financial responsibility through bonds or insurance.

• Requires intrastate transportation of fireworks only in non-passenger vehicles with competent drivers age 18+, equipped with specified fire extinguishers, complying with U.S. Department of Transportation regulations, and prohibiting smoking during loading and transport.

• Establishes storage requirements for fireworks at wholesaler, dealer, or jobber sites, including location distance minimums from inhabited buildings, passenger railways, and public highways based on pounds stored (ranging from 25 feet for 100 pounds or less to 220 feet for 200,001+ pounds of Class B fireworks).

• Makes violations of the new fireworks regulations a misdemeanor offense and repeals the 2011 Michigan Fireworks Safety Act (2011 PA 256).
