Surgical removal of human organs for transplantation must occur only in hospitals licensed under article 17, director-approved facilities, or federally designated organ procurement organization facilities.

Removal of tissue, corneas, or whole eyes may also occur in mortuaries operated by licensed mortuary science practitioners or in morgues/facilities operated by county medical examiners.

Licensed allopathic or osteopathic physicians are exempt when performing biopsies or routine tissue removal in their private practice offices for patient diagnosis or treatment, not for transplantation purposes.

Director of the department of licensing and regulatory affairs may promulgate rules to designate additional approved facilities for organ removal surgeries.

Violation of facility requirements for organ removal is a felony offense.
