Establishes exclusive control by real property owners over the 300 feet of atmosphere or airspace immediately above their property surface.

Permits property owners to grant permission to enter the immediate reaches above their property and allows commercial use of this airspace.

Authorizes state agencies, employees, and local government agents to enter the immediate reaches without permission only with a valid warrant or during exigent circumstances.

Preserves existing federal aviation rights, local ordinances, state and federal restrictions on aerial structures, and does not affect atmospheric or airspace control above the 300-foot limit.

Takes effect 90 days after enactment, contingent upon Senate Bill No. 700 being enacted into law.
