Preempts local governments (counties, townships, cities, villages) from adopting or enforcing ordinances that regulate, prohibit, restrict, or impose fees or taxes on auxiliary containers (bags, cups, bottles, or packaging made of cloth, paper, plastic, cardboard, aluminum, glass, or similar materials).

Exempts curbside recycling programs, designated recycling locations, and commercial recycling programs from the preemption restrictions.

Does not apply to local ordinances prohibiting littering or regulations governing the use of auxiliary containers on property owned by the local government.

Effective date: March 28, 2017 (90 days after December 28, 2016 enactment).
