Only prospective adoptive parents may advertise for, solicit, or recruit biological parents or guardians for court-supervised adoptions.

Biological parents, guardians, courts, departments, or child-placing agencies may only advertise for or recruit potential adoptive parents to fulfill adoptions of specific children in their care.

No other person or entity may advertise for, solicit, or recruit prospective parents for facilitating the transfer, adoption, or permanent placement of a child.

First violation is a misdemeanor punishable by up to 90 days imprisonment or $100 fine; subsequent violations are felonies punishable by up to 4 years imprisonment or $2,000 fine.

"Advertise for, solicit, or recruit" means communicating in writing or via any medium, public or private, to locate previously unknown persons with whom to temporarily or permanently place a child.
