Beginning January 1, 2017, probationers sentenced to temporary incarceration for technical probation violations are limited to a maximum of 30 days in state or local correctional facilities.

After serving the 30-day temporary incarceration period, probationers may be returned to probation under their original terms or a new probation order at the court's discretion.

The 30-day limit does not apply to probationers who have committed 5 or more technical probation violations.

Courts retain authority to revoke probation and impose new sentences under existing law for any probation violation, including technical violations, at any time during probation.

"Technical probation violation" is defined as a violation of probation terms that does not constitute a violation of state, local, federal, or tribal law; takes effect 90 days after enactment.
