Criminalizes assault or assault and battery against an individual with a developmental disability when the perpetrator knows of the disability as a misdemeanor punishable by up to 1 year imprisonment or $1,000 fine.

Elevates the offense to a felony punishable by up to 5 years imprisonment or $5,000 fine if the perpetrator has one or more prior convictions for the same offense or substantially corresponding ordinance violations.

Exempts individuals using necessary reasonable physical force in compliance with section 1312 of the revised school code from prosecution under this provision.

Defines "developmental disability" by reference to section 520a(b) of the Michigan penal code.

Takes effect 90 days after enactment.
