Senate Bill No. 1040 Summary

• Rescind Michigan administrative rule R 325.175 relating to disease control measures in schools and group programs.

• Prohibit the Department of Health and Human Services from promulgating rules that allow local health officers to exclude individuals from school or group programs based on lack of immunity documentation outside of epidemic situations.

• Prohibit the department from imposing additional or different requirements for immunization exemptions beyond the medical exemption (physician certification) and religious/personal objection exemption (written parental statement) already provided in statute.

• Require the department to include information about immunization effectiveness and potential risks whenever it provides information to the public about available exemptions.

• Effective 90 days after enactment, contingent upon Senate Bill No. 1039 of the 98th Legislature also being enacted into law.
