Removes subsection (iii) violations from mandatory life imprisonment requirements for second or subsequent drug convictions, limiting life sentences to violations of section 7401(2)(a)(ii) and section 7403(2)(a)(ii) only.

Maintains existing penalties for second or subsequent offenses under section 7410(2) or (3), requiring minimum 5 years imprisonment with possible enhancement up to twice the authorized term.

Allows courts to depart from minimum imprisonment terms under subsection (3) if substantial and compelling reasons are found and recorded.

Defines second or subsequent offenses to include prior convictions under Michigan drug statutes or any federal or state narcotics, marijuana, depressant, stimulant, or hallucinogenic drug laws.

Takes effect 90 days after enactment, contingent on passage of another specified Senate or House bill (request no. 05755'16a).
