SB-1170 Summary

• Allows parents or guardians of children or youth with special health care needs (under 21 years old) to request fingerprints and photographs be taken and added to state AFIS database and statewide photo network through department-approved entities.

• Requires written request on a department form and execution of a signed waiver by parent or guardian at time of fingerprinting and photography.

• Authorizes the Department of State Police to charge a fee sufficient to cover processing costs for requests, collected by department-approved entities and forwarded to the department.

• Permits parents or guardians to request removal of their child's or youth's fingerprints and photographs from AFIS database and statewide photo network, which the department must comply with upon written request.

• Clarifies conditions under which governmental units may fingerprint children, including with parental written authorization for runaway/missing child cases, by court order, when required by law, or with written permission for specific criminal investigations.
