Health insurance policies delivered or renewed in Michigan must cover at least one abuse-deterrent opioid analgesic drug product per opioid analgesic ingredient.

Cost sharing for brand-name abuse-deterrent opioid drugs cannot exceed the lowest cost-sharing level applied to other brand-name prescription drugs under the policy.

Cost sharing for generic abuse-deterrent opioid drugs cannot exceed the lowest cost-sharing level applied to other generic prescription drugs under the policy.

Insurers cannot require patients to first use non-abuse-deterrent opioid drugs before covering abuse-deterrent opioid drugs, and cannot increase patient cost sharing or penalize prescribers to achieve compliance.

Insurers may still apply utilization review requirements including prior authorization to abuse-deterrent opioid products if applied equally to all opioid drugs with the same release type (immediate or extended).
