Bill Summary: HB 4100 - Stormwater Utility Act

• Establishes the "Stormwater Utility Act" authorizing local units of government (cities, villages, townships, counties) to create stormwater management utilities to protect against flooding, water pollution, and property damage.

• Requires local governments adopting stormwater utilities to adopt both a stormwater management plan (by resolution) and a stormwater utility ordinance, with provisions including service area definition, cost projections, impervious area inventory, and fee calculation methods.

• Authorizes stormwater utility fees based on property's impervious area, equivalent residential units, intensity of development, or equivalent hydraulic area, with fees proportionate to the cost of providing stormwater management services.

• Requires stormwater utilities to establish reduction or elimination of fees for properties that implement modifications reducing stormwater runoff, and mandates establishment of an appeals board with at least 2 licensed professional engineers to hear fee disputes.

• Requires all stormwater utility fees to be deposited into a dedicated fund used only for stormwater management costs including planning, construction, operations, maintenance, and administration; takes effect 90 days after enactment.
