HB 4148 Summary

• Amends the Freedom of Information Act (1976 PA 442) to modify Section 13 regarding public record exemptions by public bodies.

• Changes the department responsible for archaeological site location rules from "Department of History, Arts, and Libraries" to "Department of Natural Resources."

• Adds new subsection (z) establishing exemptions for records in the executive offices of the governor and lieutenant governor relating to appointments, removals, reprieves/pardons, budget recommendations, expenditure reductions, and legislative messages.

• Deletes subsection (4) which previously prohibited withholding public records transferred to the governor's or lieutenant governor's office after a FOIA request was received by another state agency.

• Effective January 1, 2019, contingent upon enactment of HB 4150.
