HB 4163 Summary

• Changes language in collective bargaining statute from "shall" to "must" regarding prohibited subjects of bargaining between public school employers and employee representatives.

• Expands prohibited subjects of collective bargaining for public schools to include: school calendar and schedule, school improvement committee composition, open enrollment decisions, charter school authorization decisions, and contracting for noninstructional support services.

• Prohibits bargaining over teacher placement decisions, performance evaluation system development and implementation, performance-based compensation decisions, and classroom observation procedures.

• Establishes that personnel reduction decisions, staffing policies, and hiring procedures following staffing reductions are prohibited subjects of bargaining within sole employer authority.

• Requires that for employees regulated by 1937 PA 4, public school employers cannot adopt discipline or discharge policies with standards different than the "arbitrary and capricious" standard specified in that act.
