HB 4402 Summary

• Adds a new exemption (subsection q) to permit requirements for installing stream gauges in inland lakes and streams designed to measure water levels.

• Stream gauge specifications: face not more than 4 feet high by 6 inches wide with readable calibration marks, attached to bottomland using a wooden or steel stake not exceeding 6 feet in length.

• Installation must occur without changing site elevations, without additional structures or fill, and with written permission from the landowner.

• Stream gauge must not cause more than minimal adverse effects on navigation and wildlife habitat, must not unreasonably interfere with water use by others, and must not interfere with water flow.

• Stream gauge must be fully removed upon completion of use; effective 90 days after enactment.
