Payment for home attendant care provided by family or household members is limited to $15.00 per hour, unless the injured person has a spinal cord injury, closed head injury, or serious neurological injury as certified by a physician.

Payment for home attendant care provided by non-family members is limited to a total of 24 hours per day, with combined family and non-family attendant care capped at 24 hours per day.

The $15.00 per hour rate for family members is subject to inflation adjustment every 3 years beginning 3 years after enactment, adjusted to reflect changes in the U.S. Consumer Price Index rounded to the nearest 10 cents.

Limitations do not apply to family members who are licensed healthcare providers under Michigan's public health code, or to care provided under insurer contracts at any agreed rate and hours.

Injured persons may request medical review to exceed the stated limitations if additional attendant care is medically necessary, and insurers remain liable for all required benefits regardless of contractor performance.
