Department of Health shall develop a nonopioid directive form allowing individuals to indicate they do not want to be administered or prescribed opioids, with the form made available on the department's website.

Individuals, guardians, or patient advocates may execute the form on behalf of a patient, which must be included in the patient's medical record when presented to a health professional.

Prescribers and nurses may still administer opioids in emergency situations at hospitals or outside hospital settings if medically necessary, and must provide information about substance use disorder services.

Health professionals, health facilities, employees, and emergency medical services personnel are protected from civil, criminal, or disciplinary liability for failing to administer or prescribe opioids to individuals with a nonopioid directive form if acting reasonably and in good faith.

Department shall promulgate rules covering procedures for recording and revoking forms, privacy compliance, and exemptions for substance use disorder treatment and hospice patients, taking effect 90 days after enactment.
